TERMS & CONDITIONS
1. Interpretation
1.1 “Gower skin Aesthetics” means Gower Skin Aesthetics Ltd (Company No. 12475550) and trading under the name Gower Skin Aesthetics.
1.2 “Goods” means those products made available by Gower Skin Aesthetics that you wish to purchase, as indicated in your Order.
1.3 “Order” means orders placed in accordance with the provisions of Section 3.1.
1.4 “Site” means the website owned and operated Gower Skin Aesthetics with URL address http://www.gowerskinaesthetics.co.uk
1.5 “You” means the person, firm or company who purchases Goods in accordance with the provisions of Section 4.

2. General
2.1 You may have other rights granted by law, including your statutory rights as a consumer and these Terms and Conditions do not affect those rights.
2.2 These Terms and Conditions supersede all previous verbal or written statements and agreements relating to the products and/or services. All information contained in our sales literature or correspondence is provided for guidance only, and does not form part of this contract, unless we agree otherwise with you in writing.
2.3 Notices served under these terms and conditions must be in writing and will be deemed to be given when personally delivered, sent by confirmed fax or 3 days after being sent by registered mail to the address set out in our Dispatch Note.
2.4 Any failure by Gower Skin Aesthetics to enforce any of these terms and conditions will not affect our right to enforce the rest of those terms and conditions.
2.5 These terms and conditions may be subject to change at any time without prior notice to you.
2.6 These terms and conditions shall be governed by and construed in accordance with English and Welsh Law.

3. Consultation Fees (DEPOSITS)
3.1 Here at Gower Skin Aesthetics, we treat every patient with the care they deserve, whilst offering competitive pricing for our treatments and procedures that reflect our team’s experience, expertise and the level of care we offer.
3.2 In order to maintain our professional and ethical standards we have a fully redeemable deposit for consultations. The fee is fully redeemed upon arrival for your consultation against your next treatments or purchase of products within 6 months of your consultation.
3.3 Your consultation fees are NOT redeemable against treatments and products, if you do not attend for your appointment, or cancel your appointment with under 48 hours notice of the scheduled time of your appointment.
3.4 Cancellations can be made by phone, email or in person with at least 48-hour notice prior to your scheduled appointment. We would be grateful if you could do so as soon as you know to avoid any confusion and to help us maintain our level of service.
3.5 Late Arrivals. We do our best to accommodate late arrivals. However, there may be times when a late arrival will result in reduced consultation or treatment time, or we may have to reschedule your appointment.
3.6 Course of treatments. If you have purchased a pre-paid course of treatments and fail to arrive for your appointment or cancel with less than 48 hours’ notice you will forfeit the treatment you booked.
3.7 Child Policy (Under 14s). We regret that we cannot allow children under the age of 14 to enter the clinic. Please be aware that we will have to turn you away if you bring someone under the age of 14 with you – for their own safety. We will endeavour to assist you or reschedule your appointment if this presents a problem for you.New patients will forfeit their booking fee and existing patients will be charged cancellation fee £60.

4. Placing Orders (PRODUCTS ORDERS)
4.1 Orders must be placed: via email, telephone or in person.
4.2 Your submission of the Order, represents an offer to purchase the Goods from gowerskinaesthetics.co.uk. We may confirm receipt of this offer via email when placed by any of these methods. Any confirmation of receipt of the Order will not constitute an acceptance by gowerskinaesthetics.co.uk of your Order.
4.3 There will be no binding contract between you and Gower Skin Aesthetics for the supply of Goods until the Goods have been dispatched to you by Gower Skin Aesthetics.
4.4 You may change your Order at any time until the Goods are dispatched by contacting Gower Skin Aesthetics by email, telephone or post. You must let Gower Skin Aesthetics know of any changes as soon as possible.
5. Description and Availability of Goods and Services
5.1 All Goods advertised for sale on our site or publications are subject to availability. If an item that you have ordered turns out to be unavailable we will inform you by e-mail or by telephone. Items are sometimes unavailable if we are waiting for deliveries from our suppliers of if our suppliers have ceased to provide these to Gower Skin Aesthetics.
5.2 We will not be responsible for any damage or losses that you may suffer if we fail to supply Goods.
5.3 We have attempted to display the Goods on the Site as accurately and fairly as possible but they may be subject to minor modifications due to improvements in their function, materials used or manufacturing process.
6. Prices (PRICING)
6.1. Prices displayed on our Site are correct at the time of display. However, we reserve the right to alter prices from time to time without notice. When we have accepted an Order, we will not change the price that applies to that Order.
6.2. We make every effort to maintain prices, but these may be subject to variations caused by factors beyond our control.
6.3. Prices displayed in Pounds Sterling (GBP) are inclusive of value added tax (VAT) at the current UK standard rate for purchases made within the UK.
7. Customers Obligations
7.1 By placing your Order, you confirm that You are aged 18 years or older, are legally able to make purchases from Gower Skin Aesthetics and are not ordering on behalf of someone less than 18 years of age.
7.2 You confirm that you are not suffering from any condition that requires professional medical attention.
7.3 You agree to use your correct name, address and date of birth and to supply any other details reasonably requested.

8. Payment Information. (HOW TO PAY)
8.1 We accept payment by cash, credit or debit cards.
8.2 Credit and debit card payments are subject to validation and authorisation by the card issuer and we will not be liable for any non-delivery or delay if a card issuer refuses to authorise payment.
8.3 Transmission of your debit or credit card number and other details in relation to payment will be at your own risk. We cannot accept responsibility or liability for failures in transmission of information deletion, non-delivery or failure to store any communications by you.

9. Delivery of Goods
9.1 We will endeavour to deliver the Goods to the address which you have given Health & Aesthetics at the time you make your purchase within 3-5 days.
9.2 If you require express delivery please contact Gower Skin Aesthetics on 01792 235344
9.3 We will endeavour to ensure that the Goods are delivered by any delivery date estimated by Gower Skin Aesthetics, but we cannot guarantee that Goods will be delivered by that date. You agree that we will not be liable to you for any loss, damage or charge incurred because of the late delivery of Goods.
9.4 The risk of damage to the Goods passes to you once they are delivered to the address specified in your instructions.
9.5 Upon delivery of Goods, you should carefully inspect them. If any of the Goods are damaged or lost, please contact Gower Skib Aesthetics immediately to inform and do not use the Goods.

10. Inspection of Goods
10.1 Nothing in these terms and conditions is to be taken to exclude or restrict rights granted to you by law in respect of goods supplied. Upon delivery of the Goods, you must inspect them carefully. If any of the Goods do not match the description or appear to be damaged or are missing, do not use the Goods or any items accompanying the Goods, and please contact Gower Skin Aesthetics by telephone 01792 235344 or email gowerskinaestheticssutton@gmail.co.uk and inform Gower Skin Aesthetics of the problem.
10.2 You must notify Gower Skin Aesthetics immediately if there are any defects in the Goods which are apparent through inspection or use of the Goods or if you experience any difficulty in using the Goods.
10.3 If the Goods are defective on delivery, Gower Skin Aesthetics shall at its absolute discretion replace such Goods or give a refund.
10.4 If the Goods are defective in accordance with any of Clauses 10.1 to 10.3, you agree to return the defective Goods to Gower Skin Aesthetics in substantially the same condition as when received by you, including all items and packaging accompanying the Goods.
10.5 Gower Skin Aesthetics shall pay the costs of postage, packing and delivery in relation to the repair or replacement of any Goods returned for the reasons set out in Clause 9.1 to 9.3 and shall, upon written request, reimburse You the reasonable costs of returning the defective Goods.
10.6 You will be liable for the costs of replacement Goods (including posting, packing and delivery) until the returned Goods are received at Gower Skin Aesthetics.

11. Liability
11.1 Nothing in these terms and conditions is to be taken to exclude or restrict rights granted to you by law in respect of Goods supplied.
11.2 Nothing in this Agreement shall exclude or limit either party’s liability for death or personal injury resulting from that party’s negligence or for fraud or for any other liability that cannot by law be excluded or limited.
11.3 We do not accept responsibility for damage to Goods caused by you.
11.4 We will not be liable to any person for damage or loss arising from the use of Goods advertised on our Site.
11.5 Without prejudice to your statutory rights the information contained in this Site is provided without warranty and in particular we do not represent or warrant that the information is accurate, complete or current or that the use of this Site will be uninterrupted or error free.
11.6 We will not be responsible for claims relating to the availability of Health & Aesthetics range, our e-commerce engine, our website, place of purchase or the success or level of sales resulting from these.
11.7 The above exclusion of liability do not apply to damage arising from personal injury or death where they result from our negligence or the negligence of our servants and agents in the course of their duty.

12. Force Majeure
Gower Skin Aesthetics shall not be liable for failure to comply with these Terms and Conditions owing to any act or event beyond its control including but not limited to natural disasters, Acts of God, riots, civil commotion, strikes, shortage of supplies, lock-outs, industrial action, war, disease or fire.

13. Data Protection
We take our data protection responsibilities seriously and will not share your personal information or details of your purchase with any third parties. For further information on how the Gower Skin Aesthetics Clinic collects and processes your data, please see our Privacy Policy.

MEMBERSHIP TERMS AND CONDITIONS

These terms and conditions (“Terms”) set out the terms of business governing the agreement between GLL (“Us”, “We”, “Our”) and You when You purchase a Membership with Us and/or use Our facilities. Gower Skin Aesthetics facilities include treatments and services operated by Us. Facilities are generally owned by Trey Bryant.. You are advised to read these Terms and rules carefully. By continuing with Your application and whenever You use Our facilities, You confirm that:
You understand and accept all of the Terms below and you will adhere to any rules. Acceptance of Your application and any subsequent withdrawal of Membership are at Our absolute discretion.
By agreeing to these Terms, You acknowledge and agree that in entering into this agreement You are not relying on any promise, assurance, statement, representation, warranty or understanding except as expressly provided in these Terms.
Where a Term is generic this applies to all customers, however some of the Terms and Conditions will only apply to specific Members, Memberships or services and treatments and may not be relevant to all customers.
DEFINITIONS
Booking Member/Membership
A Member/Membership who pays full price for activities on an “as and when” used basis.
Commencement Date
The date on which Your Membership starts.
Cooling Off Period
Means 14 calendar days from the date and time You purchase any Membership from Us.
Cut Off Date
The last date that changes can be made to your next Direct Debit payment.
Data Protection Legislation
The UK General Data Protection Regulation, the Data Protection Act 2018, and the Privacy and Electronic Communications Regulations 2003, as amended, replaced or superseded, and all other applicable laws and regulations relating to the processing of personal data and privacy together with any applicable guidance and/or codes of practice issued or endorsed by the Information Commissioner or relevant government department in relation to such legislation. The terms Data Controller and Personal Data have the meanings given to them in this legislation.
Direct Debit (“DD”)
Contractual arrangement made with Your bank that allows Us to collect on agreed dates Fees or other monies You owe to Us.
Exceptional Circumstances
Means significant illness (which precludes you from the use of your treatments or services), significant injury (which precludes you from the use of your treatments or services), loss of livelihood, change of principal place of work or home (where you could not reasonably be expected to use your treatments or services or any other circumstance You can evidence to our reasonable satisfaction to be exceptional and require early termination of Your Membership.

On-going or upfront amounts payable for Membership.

FRESHA
The centre at which Your Membership is registered, unless altered by You. This will be the centre selected by You during the membership joining process, or the centre at which you joined.
Late Cancellation Charge
A charge made for cancellation made less than 4 hours before the treatment or service Booking start time.
Member
“You” – whichever Membership that You have selected, You are a valid Member so long as You pay the Fees that are due on time and You adhere to the Terms and Conditions and facility and / or treatment/ services rules. ‘You’ also applies to any individual aged less than 18 years on whose behalf you are signing
Membership
Membership is for a single location GSA
Membership Freeze
A change in Your Membership status that will temporarily stop your Monthly Payment Fee from being taken for a specific length of time. During this period Your Membership access will also be stopped. After the Freeze period expires Your Monthly Payments and access will automatically be reinstated.
Membership Customer Portal
Where You can access and manage details of Your Membership and Treatment/ Services Bookings FRESHA
Monthly Member/Membership
A Member/Membership who pays monthly in advance by Direct Debit
Monthly Payment Fee
A monthly fee paid in advance for a set of included activities that are a benefit of the membership type
MEMBERSHIP
1.1 If Your application for Membership is accepted, Your clinic will automatically be assigned as defined above.
1.2 You must have valid proof of Membership on each occasion that You access Our facilities. If you cannot provide relevant proof, You will be refused the benefits of Your Membership on that occasion. Where available You will be able to purchase instead an treatment / service Booking at the standard price.
1.3 Not all memberships offer the same level of benefits. It is important you check the included and excluded benefits, treatment and services before submitting your membership application. These can be found by clicking “View Details” on your chosen membership type at Step 2 of the membership purchase.
1.4 Use of the treatments and services must always be in accordance with Your Membership. You are required to pay for and have a valid booking for all activities in which You participate that are not included in the benefits of Your particular Membership.
1.5 Your Membership is non-transferable. You must not allow anyone else to use Your Membership. If You allow Your Membership to be used by any other person, Your Membership will be cancelled without refund of any Fees; no further or future applications for Membership will be accepted for a minimum of 12 months. Future eligibility for Membership will be reviewed at least annually upon request.
FEES AND PAYMENT
2.1 A Set Up Fee is payable on some Memberships (unless waived as a promotional offer).
2.2 All Fees paid in advance are non-refundable, unless the circumstances set out in the cancellation provisions within clause 5 or clause 5 apply.
2.3 Unless in accordance with a Membership Freeze or where a Membership has been cancelled in accordance with clause 5 below or the general cancellation provisions set out Clause 5, Your Membership Payment Fees shall remain payable throughout the Membership period irrespective of Your use of the servicers and treatments.
2.4 We operate a Cooling Off Period on all Memberships. This means that if you change your mind and for any reason decide that You do not want to continue with your Membership, You can notify Us of your decision to cancel within 14 days of and We will not charge you. All fees paid in advance will be refunded, providing that you have not waived your right to cancellation by making use of the Membership during this period.
2.5 You will need to purchase a new Membership in order to continue using the treatemetns and services if Your existing Single Payment Membership expires without a renewal being put in place, or if any Monthly Membership Payment is missed for any Monthly Membership. Such new Memberships will attract the usual Set Up Fee and Pro-Rata Fee where applicable.
Monthly Membership
2.6 Where You join as a Monthly Member You must pay by DD. You can select the DD collection date at the time of joining.
2.7 Monthly DDs are a full binding contract between Us and You and will automatically continue until You notify Us otherwise in accordance with these Terms.
2.8 Failure to make any due payment will initially result in Us removing Your access to Membership benefits until all outstanding payments owed to Us have been made. We retain the right to formally recover all outstanding balances.
2.9 All Membership prices are reviewed from time to time and at least once per calendar year. If Your Fees are paid by DD and are due to be changed, We will notify You at least 10 working days in advance by email and/or by letter.
TREATMENT / SERVICES BOOKING/CANCELLATION/PAYMENT
3:1 You are encouraged to make your Treatment Service Booking in advance to secure Your place, however should You require assistance Our staff will be able to assist You if you contact them directly. You can book online via the Membership Customer Portal in FRESHA.
3.2 All bookings must be made in the name of a specified Member. Bookings are not transferable between customers.
3.3 You must comply with all our TREATEMTNS AND SERVICES Terms and Conditions at all times, they are available to view at gowerskinaesthetics.com
Treatment/ Service Booking Payment
3.4 All treatment service Bookings for treatment services NOT included in Your Membership must be paid for at the time of booking and are non-refundable. If You arrive late for Your booked activity, GSA has discretion to refuse You the treatment or service.
3.5 Monthly and Pay annually Members can make treatment and service Bookings via the FRESHA App
Treatment/ Service Booking Cancellations
3.6 We recommend that you cancel your booking via the FRESHA App or Membership Customer Portal. Alternatively you can cancel in person by contacting the clinic directly.
3.7 There may be occasions where you are legitimately not able to provide more than 4 hours’ notice to cancel Your treatment or service Booking - these instances might include a sudden emergency, illness or incident, or health conditions Should this be the case, members can contact us at the clinic directly or via our Customer Service Team, to request to have the late cancellation charge waived.
3.8 Any Late Cancellation and No Shows will be noted on Your Membership record and Your ability to use Our facilities or make further bookings will be blocked until discretion of the owner.
MAKING CHANGES TO YOUR MEMBERSHIP
4.0 You should ensure that Your Membership details are kept up to date. You can access Your own information via the Membership Customer Portal FRESHA UK App or You can ask our Customer Service Team to update Your records by emailing us at gowerskinaestheticssutton@gmail.com
4.1 Should You wish to change Your bank details please use the FRESHA Online.
4.2 Any requests for Membership refunds will be dealt with in line with and these Terms and according to the type of Membership You have.
Monthly Memberships
4.3 You can cancel your Monthly Membership with Us Yourself via the FRESHA by selecting ‘My Account’ then ‘Memberships’ then ‘Manage Membership’ then ‘Cancel Membership’ You will need to provide a minimum of 20 calendar days’ notice before Your next DD date to prevent further DD payment collection.
4.4 All cancellations made prior to the relevant Cut Off Dates of either 20 days or 1 month will be effective prior to the date the next DD collection is due and no further DD collection will be made. Cancellations received after the relevant Cut Off Dates will result in one final DD being collected on the next DD due date.
4.5 We understand that You may wish to consider cancelling if We make significant changes to the treatments and services covered by the Membership, which includes any price increases affecting Your Membership. Where we are unable to give you one month’s prior indication of any price increase and You wish to cancel as a result of this change You may do so by giving Us written notice of less than one month and Your responsibility to pay Fees will continue until the date immediately prior to the date on which the increase takes effect.
Single Payment Annual Membership
4.6 If you do not renew Your Single Payment Membership before it expires, it will automatically terminate at the end of the Membership term.
4.7 You will only be entitled to a refund on a Single Payment Membership if Exceptional Circumstances apply to You and by contacting Us at gowerskinaestheticssutton@gmai.com and setting out the Exceptional Circumstances. We will then consider your request and if We are satisfied that Exceptional Circumstances apply to You we will process your refund in accordance with clause 4.8. We may, acting reasonably, request evidence of your Exceptional Circumstances.
4.8 If You do cancel a Single Payment Membership because Exceptional Circumstances apply, You will be charged at the Monthly Payment Fee rate for the proportion of the membership year prior to Your cancellation and we will refund You the remaining balance within 30 days. By way of example only, if the cost of a of a Single Payment Membership is £360 a year and You give Us notice of cancellation six months into Your Membership term We will refund you £180.
Freezing Your Membership
4.9 You may request that We freeze Your Monthly Membership if You are temporarily unable to continue participating for medical reasons or pregnancy. We may require reasonable evidence to support Your request. If We agree to Your request, We will activate the freeze from the date We receive that evidence.
5.0 You may request that We freeze Your Single Payment Membership if You are temporarily unable to continue participating for medical reasons or pregnancy. We may require reasonable evidence to support Your request. If We agree to Your request, We will activate the freeze from the date We receive that evidence.
5.1 We will consider freezing Your Membership for non-medical reasons. You must apply in writing at gowerskinaestheticssutton@gmail.com Memberships may at Our absolute discretion be frozen for a maximum of 3 months* within a 1 year period starting from the Commencement Date. Eligibility for a Membership freeze is restricted and supporting documentation will be required. Please ask a member of staff for further details. A nominal ‘Freeze fee’ may be charged each month via DD for non-medical freezes. *Dependent on reason.
5.2 In the case of any Membership freeze of Single Payment Membership, the period will not form part of the term of the Membership. For example, if the remainder of the term of a Membership is 4 months at the point of the freeze, when the Membership is reactivated, the remainder of the Membership will still be 4 months.
DATA PROTECTION
6.1 As the Data Controller of the Personal Data We hold about You, We are responsible for upholding Your privacy rights, including Your right to access Your data and to ask for it to be rectified, erased or its use to be restricted, by complying with all relevant Data Protection Legislation. You can exercise your rights by contacting privacy@gll.org
6.2 We need to process the personal data You provide to Us in Your Membership application and the data We collect about Your usage of our facilities in order to provide Our services to You, to manage and administer Your membership, to conduct financial audits and deal with financial queries.
6.3 Where We collect ethnicity data We process this on the basis that the processing is necessary for i) the performance of tasks carried out in the public interest; and ii) necessary for reasons of substantial public interest.
6.4 Any special category data is collected and processed on the basis of explicit consent which You may withdraw at any time (see privacy notice on Our website for details on the potential impact of this and how to notify Us).
6.5 For further details on how and why We process Your personal data please refer to Our Privacy Notice which can be found here at gowerskinaesthetics.com
6.6 Your personal data (including special category data) will be automatically deleted 2 years after expiry or cancellation of the membership or in some cases 2 years after the last recorded use of the benefits.
RESPONSABILITES
Our Responsibility to You
7.1 We want You to enjoy peace of mind with Your Membership and Your wellbeing is of key importance. We will compensate You for any foreseeable loss or damage You may suffer if We fail to carry out Our obligations under these Terms or to a reasonable standard, or if We breach any duties imposed upon Us by law (including if We or Our employees, sub-contractors or agents cause death or personal injury to You by Our negligence) unless that failure is attributable to:
7.1.your own fault
7..2 a third party unconnected with Our provision of the facilities; or
7..3 events which We could not have foreseen or prevented even if We had taken all reasonable care.
Your Responsibility to Us
7.4 By using any facility, You are deemed to be fit and able to participate in the activity(ies) offered. Please refer to clause 3.10 and 3.11 for full details.
